A functional suitcase bomb = art?

I'm not sure what to say after reading this post and this article from the New York Observer. It seems that Chris Hackett (who is currently out on bail from weapons charges stemming from what police found in his apartment after he blew half his face off creating other "art") has decided that the best way to express himself would be to make a fully functional suitcase bomb with a cellphone trigger, and have it displayed in an art gallery. How does this constitute art? Who could possibly think that a dude with an eye patch should be trusted?
